This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Thomas Oury, operating as methodolojee ("Developer," "We," "Us," or "Our"), for use of the Axon mobile application ("App" or "Axon").
By downloading, installing, or using Axon, You agree to be bound by this Agreement. If You do not agree, do not download, install, or use the App.
Subject to the terms of this Agreement, We grant You a limited, non-exclusive, non-transferable, revocable license to download, install, and use Axon on devices You own or control, for personal, non-commercial purposes.
Axon's source code is available under the MIT License. If You wish to modify, redistribute, or build upon Axon's source code, please refer to the LICENSE file at: https://github.com/methodolojee/Axon/blob/main/LICENSE
This EULA governs Your use of the compiled App from the App Store. The MIT License governs use of the source code.
Axon is a personal AI orchestration system that:
- Connects to third-party AI providers (OpenAI, Anthropic, Google, xAI, and others)
- Stores conversations and memories locally on Your device
- Enables switching between AI models within conversations
- Provides memory-based context enhancement for AI interactions
- Axon does not provide AI capabilities itself—it connects to third-party AI services
- Axon does not store Your data on our servers (all data is stored locally on Your device or via Your iCloud account)
- Axon does not have access to Your API keys after You enter them (they are stored in Your device's secure Keychain)
To use Axon's AI features, You must:
- Obtain API keys from third-party AI providers (OpenAI, Anthropic, Google, etc.)
- Agree to and comply with those providers' terms of service
- Pay any fees charged by those providers for API usage
You are solely responsible for:
- Your use of third-party AI services through Axon
- All charges incurred from third-party AI providers
- Compliance with third-party providers' terms of service and acceptable use policies
- The content You submit to AI providers through Axon
Axon's integration with third-party AI providers does not constitute an endorsement, partnership, or affiliation with those providers.
Axon is designed with privacy as a core principle:
- Conversations are stored locally on Your device using SwiftData
- Memories are stored locally on Your device
- API keys are stored in Your device's secure Keychain
- No data is transmitted to methodolojee servers
If You enable iCloud sync:
- Your data syncs through Your personal iCloud account
- Data is encrypted in transit and at rest per Apple's iCloud security practices
- We do not have access to Your iCloud data
- You can disable sync at any time in Settings
When You use AI features, Your messages are transmitted to:
- The AI provider You have selected (OpenAI, Anthropic, Google, etc.)
- Subject to that provider's privacy policy and data practices
We encourage You to review the privacy policies of any AI providers You use.
Axon may collect anonymized, aggregated usage analytics (such as feature usage frequency) to improve the App. This data:
- Contains no personal information
- Contains no conversation content
- Contains no API keys
- Can be disabled in Settings
You agree to use Axon only for lawful purposes and in accordance with this Agreement. You agree NOT to:
- Use Axon to violate any applicable law or regulation
- Use Axon to generate, store, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to reverse engineer, decompile, or disassemble the App (except as permitted by applicable law or the AICL)
- Use Axon to infringe intellectual property rights of others
- Use Axon in any way that could damage, disable, or impair the App or third-party services
You acknowledge that:
- AI-generated content may be inaccurate, incomplete, or inappropriate
- You are responsible for reviewing and verifying AI outputs before relying on them
- We are not responsible for any actions You take based on AI-generated content
The App, including its design, graphics, user interface, and original content, is owned by Thomas Oury / methodolojee and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of:
- Conversations You create
- Memories You create or that are generated from Your interactions
- Any other content You input into the App
Axon's source code is available under the AICL 1.0 license. Nothing in this EULA restricts Your rights under that license with respect to the source code.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
WE DO NOT WARRANT THAT:
- The App will meet Your requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from the App will be accurate or reliable
- Any errors in the App will be corrected
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL THOMAS OURY, METHODOLOJEE, OR ANY AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES RESULTING FROM YOUR USE OF THIRD-PARTY AI SERVICES
- ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA
- ANY DAMAGES RESULTING FROM AI-GENERATED CONTENT
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50 USD), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Thomas Oury, methodolojee, and any affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of this Agreement
- Your violation of any third-party rights
- Your violation of any applicable law or regulation
- Content You submit through the App
This Agreement is effective until terminated.
You may terminate this Agreement at any time by deleting the App from all Your devices.
We may terminate or suspend Your license immediately, without prior notice, if You breach any term of this Agreement.
Upon termination:
- Your license to use the App ends immediately
- Your locally stored data remains on Your device (we have no ability to delete it)
- Provisions that by their nature should survive termination shall survive
We may release updates to the App from time to time. Updates may:
- Add, modify, or remove features
- Fix bugs or security vulnerabilities
- Change system requirements
We may update this Agreement from time to time. We will notify You of material changes through:
- In-app notification
- Email (if You have provided one)
- Notice on our website
Continued use of the App after changes constitutes acceptance of the updated Agreement.
This Agreement is governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
Any dispute arising from this Agreement shall be resolved through:
- Good faith negotiation between the parties
- If negotiation fails, binding arbitration in Denver, Colorado under AAA rules
- Small claims court actions are exempt from arbitration requirements
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions continue in full force.
This Agreement, together with the AICL license for source code use, constitutes the entire agreement between You and Us regarding Axon.
Our failure to enforce any right or provision of this Agreement does not waive that right or provision.
You may not assign this Agreement without Our prior written consent. We may assign this Agreement without restriction.
If You downloaded Axon from the Apple App Store:
You acknowledge that this Agreement is between You and methodolojee only, not with Apple Inc. ("Apple"). Apple is not responsible for Axon or its content.
The license granted to You is limited to a non-transferable license to use Axon on Apple-branded products You own or control, as permitted by the App Store Terms of Service.
methodolojee is solely responsible for providing maintenance and support services for Axon. Apple has no obligation to provide maintenance or support.
methodolojee, not Apple, is responsible for any product warranties, whether express or implied. Apple has no warranty obligation.
methodolojee, not Apple, is responsible for addressing any claims relating to Axon, including product liability claims, claims that Axon fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that Axon infringes intellectual property rights, methodolojee, not Apple, is responsible for investigation, defense, settlement, and discharge of such claim.
Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon Your acceptance, Apple has the right to enforce this Agreement against You as a third-party beneficiary.
